PA CASE THAT SHOWS CERTIFICATION DOES NOT EXTEND DEADLINE.

Listen up, America. This election is being stolen right before your very eyes.

Yesterday, I published an extensive post proving that all of the recounts taking place in Pennsylvania are illegal. In that post, I dismantled the myth going around the media - giving cover to rogue partisan election boards/judges - that certification of the final vote must take place before the initial deadlines are reached to petition for a recount/recavass.

THE CERTIFICATION DEADLINE IS A LIE. 

My post yesterday contained some technical statutory analysis and case law. But anyone taking the time to carefully read it will see that my conclusions are absolutely correct.

I have just come across another case that further solidifies my argument in clear, easy to digest language. I am adding this short post today, so that you can share it with your friends and family, tweet it, and make them understand just how dangerous this situation has become. I have never seen anything like it. The election boards and the Judiciary know that these recounts are completely time-barred and illegal, yet they go on despite multiple cases that clearly illustrate the real deadline passed on November 21st. 

Here is the relevant quote from the Commonwealth Court, the same court that Jill Stein's fraudulent election contest has been brought in:

"Orsatti, in her petition, alleged fraud or error in the computation of the votes or the marking of the ballots. Section 1703 of the Code, 25 P.S. § 3263, permits such a petition to be filed before the certification of the returns and 'no later than five (5) days after the completion of the computational canvassing of all the returns of the county by the county board....' "

As I have been saying all along, a petition to recount may be brought up until the time of the official certification, but no later than 5 days after the statutorily mandated completion of the computation of the county by county vote. This year the computation had to be completed by November 15th. The fifth day after was November 20th, but that fell on a Sunday, so the deadline was extended until November 21st.

Therefore, all recounts currently being considered, and currently ongoing, in Pennsylvania, are strictly barred and completely illegal.

And the fact that nobody on Donald Trump's legal team, or the legal team for the Republican party, has made motions to quash all of these recount efforts in Pennsylvania is frightening.

I spoke with one of the members of Donald Trump's legal team yesterday for 16 minutes, and I am not impressed at all with their filed response to the election contest, or their failure to do anything to stop all of the recounts. 

That these recounts are taking place in Pennsylvania under their watch borders on malpractice, if not an outright revolution.

    1. A pack of lies. I will expose that. Deadline before the board is not five days after...it is the 15th. Five days after is the second deadline. The returns must be signed before submission to Secretary of Commomwealth. They remain unofficial for five days, then automatically become official after five days. Certification can then happen after returns become official. After the five days. This is a judicial coup d'etat. I will prepare a full post on this Incline story. Thanks for sending.

    4. So why isn't Trump's team aware of this and properly objecting? In Michigan, it's a clear 14th amendment issue as Bush V Gore. What people do not consider here is the very intent and reason for certification - SO PEOPLE CANNOT SUBVERT an election. These machines can be re programmed here as there to bring up an entirely different result. Then, the Dems will shout " there is our proof" accusing the Russians when they themselves are the ones rigging it -- hello to WW3. Rule of law is important in our society and it's being spit on all in the guise of 'fairness'... Leftists can care less about the rule of law, only getting votes and will subvert it.. However, if Trump and the GOP can care less, what can anyone do about it?

    5. Also, they can't steal the election anyways. GOP controls the so called congressional gavel. They would just object to a changed result, throw out PA and any other subverting state, then go by the majority of States and confirm Trump. What this does however is cast illegitimacy on Trump's Presidency, and most Americans are ignorant to law, case precedence such as Gore V Bush and that 7-2 ruling on the 14th amendement -- that Bush's rights were being violated. Dems don't care, many of them will do anything to win, including subverting our constitution and state laws.

  2. We have all found our way here because we have a sense that something is wrong, that Trump and the entire conservative movement is underestimating the nature, severity, and danger of this "recount" threat.

    It doesn't get more important than this. Our republic literally hangs in the balance and this IS the time. We will not have a moment like this again. I think Trump may have been fooled by Hillary & Obama's quick concessions, and further fooled by the fact that this entire subversive movement was funneled through the underestimated, seemingly irrelevant character of Jill Stein.

    Men, we must stand and do everything within our legal means to make sure this theft of our republic is not allowed to occur. It is not enough to be passive observers and sit on the sidelines, asking "Why aren't they doing something?"

    "Why aren't we doing something?" We will not have this moment in history again. If a challenge must be filed in the courts, then let us file it in the courts. I am not a lawyer and do not know the intricacies as Jander does. But I am willing to go to PA if that's what it takes to file whatever needs to be filed. We must concentrate our resources and strengths and do the job that others are not doing. If not us, who? If not now, when?

    Let's talk about what we can do, so that we do not look back on this moment in history with regret and tell our children we did not do all we could do.

  5. Here is what hardly anyone is considering and I think people here should consider this. Let's say the subverters manage to cheat a state or 2 for Hillary (Mich supreme court will not allow recount on 14th amendment, see Bush V Gore, 7-2 decision for Bush), Obama and Hillary are on the record stating that a cyber attack from Russia against America would be considered and act of war. Are these subverters considering this = that this can possibly lead to WW3 that would likely include nukes? Have people thought this out to its potential disastrous conclusion?

  6. Not sure Bush Gore is any way of a precedent, other than part of it. If I remember, the ruling specifically stated it wasn't a precedent for future elections, although I am sure the parts pertaining to procedural process may apply. Right now, is a fishing expedition, and the media is running with it, and there is too much room for illicit behavior.
